Gateway Ice Centre Facility Terms and Conditions for Ice Rentals

The following Terms and Conditions form part of all commitments and/or agreements for ice rentals at Gateway Ice Centre and constitute the terms of use for all user groups and organizations utilizing the facility, whether a formal contract is executed between the parties or not.

By using the facility, the user agrees to be legally bound by these Terms and Conditions.

General Facility Use

A sixty (60) minute ice rental consists of fifty (50) minutes of ice time and ten (10) minutes allocated for ice maintenance.

Groups causing damage to the ice surface may have their ice time reduced to allow maintenance staff to complete necessary repairs. Continued damage to the ice surface may result in the revocation of future ice times.

Gateway Ice Centre shall not be liable for any indirect, consequential, incidental, special, punitive, or economic damages arising from or related to the use of, inability to use, or interruption of use of the facility, including but not limited to lost profits, lost revenue, lost registrations, travel expenses, accommodation expenses, officiating costs, tournament expenses, business interruption, or any other related costs or losses. In all circumstances, Gateway Ice Centre's liability shall be limited to the actual rental fees paid for the affected ice rental or facility use. The user, group, or organization acknowledges and agrees that this limitation of liability is reasonable and forms a fundamental part of the agreement between the parties.

Gateway Ice Centre shall not be liable for any failure or delay in providing facility access or ice rentals due to causes beyond its reasonable control, including but not limited to acts of God, weather events, power outages, equipment failures, refrigeration failures, labour disputes, governmental orders, public health emergencies, pandemics, or other emergencies.

All users, groups and organizations are required to provide a Certificate of Insurance in the amount of $2,000,000 Comprehensive General Liability Insurance covering Property Damage and Bodily Injury. Where applicable, coverage must include Participant Liability, Liquor Liability, Tenant Legal Liability, and any other insurance deemed necessary by Gateway Ice Centre. The policy must include cross-liability and severability provisions and name Gateway Ice Centre and 610 South Service Road Inc. as additional insureds. This documentation must be submitted no later than two (2) weeks prior to the first rental date. The policy shall not be cancelled without sixty (60) days written notice to Gateway Ice Centre. Where a user group or organization does not carry their own liability insurance, Gateway Ice Centre may, at its sole discretion, permit the use of the facility under the liability insurance maintained by Gateway Ice Centre, subject to any additional requirements, waivers, or administrative fees that may apply. Acceptance of any Certificate of Insurance by Gateway Ice Centre shall not limit, waive, or reduce the responsibility or liability of any user, group, or organization under these Terms and Conditions.

All users, groups and organizations hereby release Gateway Ice Centre from liability for personal injury or loss of property. The user, group or organization agrees to indemnify and save harmless Gateway Ice Centre from and against any and all actions, causes of action, claims, and demands arising out of or by reason of the occupation and use of the facility by the user group or organization.

All users, groups and organizations acknowledge that the activities they participate in within the facility may be inherently dangerous and willingly assume those risks.

Gateway Ice Centre shall not be responsible for loss, theft, or damage to vehicles or their contents while parked on facility property.

Users, groups and organizations shall ensure that all participants wear appropriate protective equipment as required for the activity. All equipment and supplies used in connection with the activity must be in safe and usable condition and must not present a hazard to participants or others within the facility.

To encourage appropriate behaviour and maintain a safe and positive environment, the group, organization, or individual renting ice at Gateway Ice Centre assumes full responsibility for the behaviour and actions of all persons associated with their program or event. Fighting or unsportsmanlike behaviour may result in the cancellation of future ice times without refund.

The renter shall be responsible for the conduct, supervision, and actions of all participants, coaches, instructors, trainers, volunteers, spectators, guests, invitees, and any other persons attending or participating in the rental. Any violation of these Terms and Conditions, facility rules, or applicable laws by such persons shall be deemed a violation by the renter and may result in removal from the facility, cancellation of the rental, suspension of future booking privileges, or other remedies available to Gateway Ice Centre.

Facility Compliance

All users must comply with facility rules, posted signage, and staff instructions at all times. Gateway Ice Centre reserves the right to remove any individual or group from the facility for failure to comply with facility rules or for behaviour deemed unsafe, disruptive, or inappropriate. No refunds will be issued in such circumstances.

Gateway Ice Centre shall not be responsible for any lost or stolen goods or money anywhere within the facility, nor for any damages or theft of property outside the facility. It is the responsibility of the user group or organization to ensure dressing room doors are locked or supervised while participants are on the ice.

Dressing room keys, access cards, access codes, or other access devices issued by Gateway Ice Centre remain the property of Gateway Ice Centre and shall only be provided to the designated team representative. The team representative is responsible for the safekeeping, control, and return of any key or access device issued. Keys shall not be copied, transferred, or provided to any unauthorized person. Gateway Ice Centre shall not be responsible for any loss, theft, or damage to personal property or equipment stored in or left within a dressing room after a key or access device has been issued to the user group or organization. The user group or organization shall be responsible for any costs incurred by Gateway Ice Centre arising from lost, unreturned, damaged, or unauthorized duplication of keys or access devices.

User groups and organizations shall be responsible for all damages caused to the building, grounds, chattels, or equipment belonging to Gateway Ice Centre as a result of malicious damage or vandalism caused by members of the group before, during, or after the rental period. Any reports, repairs, or administrative work required as a result of such damage will be invoiced to the user, group or organization and must be paid in full. Failure to pay for damages may result in legal action.

User groups are responsible for ensuring that minors are adequately supervised at all times while on facility property, including dressing rooms, hallways, parking areas, and spectator areas.

Users, groups and organizations will be permitted access to their assigned dressing rooms thirty (30) minutes prior to their scheduled rental time and must ensure dressing rooms are vacated within thirty (30) minutes after the rental has concluded. Dressing rooms must be left in a clean condition.

Gateway Ice Centre reserves the right to apply reasonable administrative charges where staff time or resources are required to address damages, rule violations, excessive cleaning, incident investigations, security matters, reports, collection efforts, key replacement, lock rekeying, access device reprogramming, or other issues resulting from the actions of the user group or organization. Such costs may include, without limitation, replacement keys, replacement locks, lock rekeying, access card replacement, access device reprogramming, labour, and any associated administrative costs.

Cellular phones and personal electronic devices may only be used in hallways or outside of the facility and are strictly prohibited in dressing rooms, washrooms, or shower areas.

Gateway Ice Centre reserves the right to accept or modify ice flood requests to maintain operational efficiency and pad coordination.

Special flood requests must be discussed with the Ice Scheduler a minimum of fourteen (14) days in advance and will be accommodated only where operationally feasible. Ice conditions may vary due to weather, facility usage, maintenance requirements, refrigeration or mechanical issues, or other operational circumstances. Such conditions shall not constitute grounds for a refund, credit, reduction in rental fees, or cancellation of any rental agreement.

Alcoholic beverages are strictly prohibited anywhere inside or outside the facility without an approved Special Occasion Permit. Violations may result in the immediate cancellation of ice time without refund.

All users must comply with the Smoke-Free Ontario Act, which restricts the use of cigarettes, vaping products, and cannabis on facility property.

Gateway Ice Centre reserves the right to curfew games where necessary to maintain the posted facility schedule.

Gateway Ice Centre reserves the right to refuse or cancel future bookings where a user has violated facility rules, damaged property, failed to make payment, provided false information, or otherwise acted contrary to these Terms and Conditions.

Gateway Ice Centre reserves the right to amend, modify, or update these Terms and Conditions at any time without prior notice.

Payment Terms and Cancellation Policy

Payment Terms

Unless otherwise approved in writing by the Ice Scheduler, Reception, or Office Staff of Gateway Ice Centre, payment in full is due at the time of booking. Gateway Ice Centre may, at its sole discretion, approve alternate payment terms for certain users, groups, or organizations, including, but not limited to, monthly invoicing, semi-monthly invoicing, or other payment schedules. All invoices are due and payable in accordance with the payment terms approved in writing by Gateway Ice Centre.

Gateway Ice Centre reserves the right, at any time and in its sole discretion, to revoke or amend any approved payment terms and require payment in advance for all future bookings. Gateway Ice Centre further reserves the right to release, cancel, suspend, or reallocate any booking for which payment has not been received by the applicable due date in accordance with these Terms and Conditions or any approved payment arrangement.

Invoice Review

It is the responsibility of the user, group, or organization to review all invoices for accuracy and notify the scheduler in writing of any discrepancies or required modifications no later than five (5) days prior to the scheduled rental date, or within five (5) business days of receipt of an invoice for ongoing contract ice. Invoices not disputed within the applicable timeframe shall be deemed accurate and accepted as issued. Delivery of an invoice by email constitutes proper notice of payment due.

Confirmed Ice Schedules

Once an ice schedule has been confirmed by Gateway Ice Centre, the renter is committed to all ice times included in the confirmed schedule. The Cancellation Policy below governs cancellations of scheduled rental dates and does not apply to requests to reduce, surrender, transfer, or otherwise modify a confirmed ice schedule, including the cancellation of all or any portion of future recurring bookings. Any such request may only be made with the prior written approval of Gateway Ice Centre, which may approve or deny such request in its sole discretion. Unless otherwise agreed to in writing by Gateway Ice Centre, the renter shall remain responsible for all ice times included in the confirmed schedule and the applicable rental fees.

Cancellation Policy

Written cancellation is required for all ice rentals. A cancellation request shall not be deemed received or effective unless and until it has been acknowledged in writing by the Ice Scheduler, Reception, or Office Staff of Gateway Ice Centre. Until such acknowledgement has been provided, the booking shall remain active and all applicable cancellation deadlines, fees, and payment obligations shall continue to apply.

Cancellation requests submitted outside Gateway Ice Centre's regular business hours shall be deemed received on the next business day unless otherwise acknowledged in writing by the Ice Scheduler, Reception, or Office Staff of Gateway Ice Centre.

Ice cancelled seven (7) or more days prior to the scheduled rental date may be cancelled without penalty.

Ice cancelled less than seven (7) days but more than seventy-two (72) hours prior to the scheduled rental date will be subject to a cancellation fee of Seventy-Five Dollars ($75.00) per hour, plus applicable taxes.

Ice cancelled within seventy-two (72) hours of the scheduled rental date shall be charged in full and is non-refundable and non-creditable, regardless of whether the cancelled ice is subsequently rebooked.

Bookings made less than seven (7) days prior to the scheduled rental date are subject to the applicable cancellation policy from the time of booking.

Any booking made within seventy-two (72) hours of the scheduled rental time is final at the time of booking and is non-refundable and non-creditable.

Statutory Holiday Rentals

No refunds or credits will be issued for ice rentals booked on Statutory Holidays.

Refund Policy

Approved refunds shall be issued to the original method of payment whenever possible (excluding cash). Refunds issued by e-transfer are subject to a Five Dollar ($5.00) administrative fee.

Subleasing, Transfers and Booking Responsibility

Ice rentals may not be assigned, transferred, sublet, shared, or otherwise provided to another individual, team, organization, or participant without the prior written consent of Gateway Ice Centre. The individual, group, or organization booking the ice shall remain the responsible renter and must be present at the facility or otherwise directly responsible for supervising and administering the activity.

Any insurance provided in support of the rental must belong to the responsible renter and may only be used in connection with that renter's operations and activities. Payment may be made by a third party; however, responsibility for payment, compliance with these Terms and Conditions, and all liabilities arising from the rental shall remain with the responsible renter. Gateway Ice Centre reserves the right to cancel rentals, refuse future bookings, or revoke booking privileges where this provision is violated.

Tournament and Special Event Rentals

Tournament and special event rentals are not confirmed or secured until the required twenty-five percent (25%) non-refundable deposit has been received by Gateway Ice Centre. Unless otherwise agreed to in writing, full payment is due thirty (30) days prior to the rental date.

Failure to remit payment by the applicable due date may result in the cancellation or release of the reserved ice time without further notice. Tournament and special event bookings cancelled within thirty (30) days of the rental date are non-refundable and non-creditable.

The renter is responsible for ensuring that all participants, teams, officials, volunteers, and spectators comply with the Facility Terms and Conditions of Gateway Ice Centre.

Gateway Ice Centre reserves the right to adjust ice schedules where reasonably required for operational purposes. Any additional ice time requested or used beyond the confirmed schedule shall be invoiced accordingly.

Late Payments

Any balance outstanding thirty (30) days after its due date shall bear interest at the rate of one and one-quarter percent (1.25%) per month (fifteen percent (15%) per annum), calculated monthly until paid in full.

Payment Enforcement

Three (3) or more late payments or cancellations may result in the account being placed on Payment in Advance status. Gateway Ice Centre reserves the right to suspend or cancel existing bookings, refuse future bookings, revoke approved payment terms, or require payment in advance where an account is not in good standing.

Outstanding Accounts

Gateway Ice Centre may refuse or cancel bookings where an outstanding balance exists, including bookings made under another individual, team, group, or organization where Gateway Ice Centre reasonably believes the booking is associated with the outstanding account.

Responsibility for Payment

The individual booking the ice represents and warrants that they have the authority to bind the organization, if applicable, and agrees that both the individual and the organization shall be jointly and severally liable for all amounts owing under these Terms and Conditions.

No dispute regarding scheduling, attendance, weather, facility conditions, ice conditions, operational issues, or any other matter shall relieve the renter of its obligation to pay invoices when due. Any dispute shall be raised separately and shall not entitle the renter to withhold, delay, deduct, or set off payment.

Collections

If an account is referred to a collection agency or legal counsel, the customer agrees to pay all reasonable costs incurred in recovering the outstanding balance, including collection agency fees, legal fees, court costs, interest, and all other recovery expenses. No user, group, organization, or individual shall withhold, deduct, set off, or otherwise reduce any amount owing to Gateway Ice Centre unless expressly agreed to in writing by Gateway Ice Centre.

Assumption of Risk, Release and Waiver of Liability & Indemnity Agreement

READ BEFORE ACCEPTING

Warranty and Consent

This waiver is made for the benefit and protection of Gateway Ice Centre, including its owners, officers, directors, employees, contractors, volunteers, agents, sponsors, advertisers, landlords, and affiliated entities (collectively referred to in this document as the “RELEASEES”).

Renter / Group Representative

Where an individual books or rents ice or facility space on behalf of an organization, team, group, program, or other participants, that individual represents and warrants that they are authorized to make the booking and enter into this Agreement on behalf of the organization, team, or group. The individual acknowledges that this Agreement applies to the activities conducted under their booking and to the organization, team, or group for which the booking is made.

The renter or group representative is responsible for ensuring that all participants, players, coaches, instructors, volunteers, guests, and other persons participating under or associated with the booking are made aware of the risks associated with the activity and comply with all applicable Gateway Ice Centre rules, safety requirements, and equipment requirements.

In Consideration

of allowing my organization/group and/or myself to participate in the program, related events and activities at the Gateway Ice Centre including but not limited to pick-up hockey, skating, games, practices, training sessions, and other on-ice or off-ice activities.

I Warrant to You That:

1. I am familiar with the risk of serious injury and death which any participant in this program must assume; and

2. I believe that I and/or my organization/group are physically, emotionally and mentally able to participate in this program, and that my and/or my organization's/group's equipment is mechanically fit for my use in this program; and

3. I understand that all applicable rules for participation must always be followed and that the sole responsibility for personal safety remains with me; and

4. I will immediately remove myself from participation, and notify the nearest official, if at any time I sense or observe any unusual hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional or mental fitness for continued participation in the program.

I Understand and Agree

On behalf of myself, my heirs, assigns, personal representatives and next-of-kin, and where applicable in my capacity as the authorized representative of the organization, team, or group identified in connection with the booking, that participation in this program and execution of this document constitutes:

1. ASSUMPTION OF ALL RISKS: an unqualified ASSUMPTION OF ALL RISKS associated with participation in this program by me even if arising from negligence, or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue operations or procedures, of the program organizer and any persons associated therewith or participating therein; and

2. FULL AND FINAL RELEASE AND WAIVER OF LIABILITY: a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of the program organizer and all persons and organizations associated with it and the program including, without limiting the generality of the foregoing, its officers, directors, officials, agents and/or employees, other participants, sponsors, advertisers, owners and/or lessors of the premises used to conduct the program, sanctioning bodies, medical or rescue personnel (the RELEASEES), of and from with respect to all injury, disability, death or loss or damage to person or property whether arising from the negligence, or negligent rescue of or by the foregoing or otherwise; and

3. UNDERTAKING NOT TO SUE: an UNDERTAKING NOT TO SUE the RELEASEES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly from the participation in this program by me; and

4. AGREEMENT TO INDEMNIFY: an AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim made against them or any one of them whether the claim is based on the negligence or the gross negligence of the RELEASEES or otherwise.

5. ACKNOWLEDGMENT AND ACCEPTANCE: an ACKNOWLEDGMENT AND ACCEPTANCE that it is my sole responsibility, and the responsibility of any participants, players, or group members included under my booking or supervision, to wear equipment and protective gear appropriate to the activity for which the ice is being used, and that the RELEASEES have no obligation to inspect, provide, maintain, or ensure the suitability of such equipment, and that any injury, loss, or damage arising from the use or lack of such equipment is expressly and voluntarily assumed by me on behalf of myself and my group.

I HAVE READ THIS DOCUMENT THOROUGHLY.

I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY PARTICIPATION AND/OR THE BOOKING AND USE OF THE FACILITY BY MY ORGANIZATION, TEAM OR GROUP.

I UNDERSTAND THAT BY ACCEPTING THIS DOCUMENT I GIVE UP SUBSTANTIAL LEGAL RIGHTS I WOULD OTHERWISE HAVE.

I ACCEPT THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.


These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

I confirm that I have read, understand, and agree to be bound by the Gateway Ice Centre Terms and Conditions and the Assumption of Risk, Release and Waiver of Liability & Indemnity Agreement, on behalf of myself and, where applicable, as the authorized representative of the organization, team, or group for which I am making this booking.
